CONDITION AND WARRANTY

LIENS AND TITLE
Seller represents and warrants that the property is free and clear of all liens, security interests, and encumbrances, and that Seller has full legal right to sell the property.
Seller agrees to transfer title/registration to Buyer as part of this sale, in accordance with applicable state law.
GENERAL PROVISIONS
This Agreement shall be governed by the laws of the State of California.
This Bill of Sale constitutes the entire agreement between the parties regarding this sale and supersedes any prior negotiations or agreements.
This is a record of a completed transaction. Once signed, ownership of the above-described property transfers from Seller to Buyer.
Any modifications to this Agreement must be in writing and signed by both parties.
State-Required Provisions
NOTICE OF TRANSFER (Cal. Veh. Code § 5900): Seller must submit a Notice of Transfer and Release of Liability to the California DMV within 5 days of the sale (online at dmv.ca.gov or by mail). Failure to do so may keep Seller liable for the vehicle after the sale.
ODOMETER DISCLOSURE (Cal. Veh. Code § 5753): Odometer disclosure is required for vehicles under 10 years old as part of the title transfer.
SMOG CERTIFICATION: Most gasoline vehicles being sold in California require a valid smog certificate at the time of transfer, unless exempt (e.g., vehicle model year 2004 or newer under 4 years old, or vehicle is a diesel over a certain weight).
SALES/USE TAX: California use tax on the purchase price is generally paid by the Buyer directly to the DMV at the time of registration, based on the county of residence.
